You get OrcaMail through Apple's App Store. Your license to use the app is governed by Apple's Licensed Application End User License Agreement. These terms add to it. Where they conflict, Apple's license agreement governs the license.
OrcaMail is an app for mail, calendar and contacts that connects to a JMAP server of your choice. We do not provide a mailbox or a mail server. You need an account on a server that supports JMAP, such as your own Stalwart server or a provider like Fastmail. The operator of that server is responsible for it, its availability and the data stored there.
We develop and test OrcaMail with Stalwart and Fastmail. We cannot promise that every JMAP server supports every feature.
OrcaMail is free to use with one account. The OrcaMail Pro subscription unlocks extra features, such as any number of accounts, OrcaMail Push, Send Later and Snooze. The app lists what is included on its OrcaMail Pro page.
Apple handles the purchase. Payment, refunds and any statutory right of withdrawal follow Apple's terms. Refunds are requested from Apple.
OrcaMail Push is a service we run that reports new mail to iPhone and iPad through the Apple Push Notification service. It is part of OrcaMail Pro. We aim to run it reliably but cannot promise uninterrupted availability, not least because it depends on Apple and on your mail server. Maintenance and outages can delay notifications. New mail is not lost: the app fetches it at the next sync. Instead of OrcaMail Push you can enter a relay server of your own.
Use OrcaMail Push only to run the app, and do not overload it, for example with automated requests from outside the app.
Connect OrcaMail only to accounts you are allowed to use, and keep your sign-in details secret. Do not use the app for unlawful purposes, such as sending spam.
OrcaMail keeps a copy of your data on the device; what counts is the state on your mail server. Backing up the data on the server is the responsibility of its operator, or yours.
We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. For slight negligence we are liable only for breaching an essential contractual obligation, one whose fulfilment makes proper use possible in the first place and on which you may regularly rely. In that case liability is limited to the foreseeable damage typical for this kind of contract. Otherwise liability is excluded.
We may update these terms, for example when the app, the law or Apple's requirements change. We announce significant changes in the app or on this page. For a running subscription, changes to your disadvantage apply only from the next renewal period; you can cancel before then.
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory consumer protection rules of the country where you normally live still apply.
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board. If you have a question or a problem, just send us an email.
These terms of use are valid as of 20 October 2026.
